Code of Ethics
Section 1
General Responsibilities
1.1 Upon first obtaining, or renewing, membership with the Quebec Region Hotel Association (hereafter referred to as “the QCRHA”), all members, member establishments and/or representatives of member establishments agree to respect these rules, share them with other members and encourage others to respect them.
1.2 All members must respect and preserve the integrity, dignity and reputation of the QCRHA, fellow QCRHA members and the accommodation industry, especially in their dealings with fellow members, clients and the public.
1.3 All members must participate and help develop QCRHA projects and activities in order to promote the common interests of all members and ensure the growth of the accommodation industry.
1.4 All members must respect QCRHA rules and decisions.
1.5 No member may lead others to believe he or she is an QCRHA spokesperson if he or she is not a member of the board of directors or has not received a mandate to represent the QCRHA in a specific field or for a clearly defined purpose.
1.6 Members must obtain permission from the QCRHA board of directors, president or general director prior to representing the QCRHA in dealings with any organization or agency.
1.7 All members must respect the exclusivity of the official QCRHA guide and map, and distribute them in compliance with QCRHA instructions for doing so. However, the in-house magazine of an establishment or chain to which an establishment belongs is not a violation of said exclusivity.
1.8 All members agree to pay the annual membership fees and any other fees within the deadlines and in accordance with the payment methods set out by the board of directors.
Section 2 Duties and Obligations Towards Other Members
2.1 All members must respect other QCRHA members, remaining courteous and civil at all times, especially when speaking to other members and taking part in events.
2.2 All members must adopt fair business practices when dealing with other QCRHA members and the accommodation industry in general.
Section 3 Conflicts of Interest
3.1 All members must avoid placing themselves in situations of conflict of interest.
3.2 Without limiting the generality of the foregoing, all members are in conflict of interest when they:
3.2.1 Support any QCRHA position, decision or commitment when their interests and/or those of their company, establishment or employer are such that the members may put their own interests or those of their company, establishment or employer before those of the QCRHA, other QCRHA members or the accommodation industry.
3.2.2 Place themselves in a position where their loyalty to the QCRHA, QCRHA members as a whole and/or the accommodation industry may be brought into question.
Section 4 Disciplinary Committee
4.1 A disciplinary committee (hereafter referred to as “the Committee”), comprising of three (3) regular members, is created by the board.
4.2 The members of the Committee are appointed by the QCRHA board of directors.
4.3 The Committee quorum is two (2) members.
4.4 The board of directors or a member in good standing may submit a written complaint about another member.
4.5 A copy of the complaint must be sent to the member against whom a complaint has been made.
4.6 The Committee must obtain the facts giving rise to the complaint.
4.7 The member who is the object of a complaint may request in writing to plead his or her case before the Committee to explain why the complaint in question must be rejected.
4.8 After conducting an investigation, the Committee shall decide what action to take in response to the complaint, taking into account whether the act(s) referred to in the complaint may be derogatory to the honour, dignity and/or credibility of the QCRHA, its members, the profession of hotelkeeper and/or the accommodation industry in general, or that the complaint against the member is contrary to the code of ethics described herein.
4.9 Committee decisions are made by a majority of its members.
4.10 The Committee renders its decisions in writing. The Committee is free to providing reasons for justifying its decisions at its own discretion.
4.11 A copy of the Committee's written decision must be given to the member concerned.
4.12 The Committee may impose one or more of the following penalties upon the member at fault: a) Reprimand; b) Temporary suspension or expulsion without reimbursement, in whole or in part, of the annual membership fees and/or any additional fees; c) Expulsion of the member from the board of directors and/or any committee, as applicable.
4.13 The Committee may make any suggestion or recommendation it deems useful or necessary to the QCRHA board of directors.
4.14 All members who are the object of a sanction by the Committee may request that the board of directors review the decision rendered by the Committee.
4.15 A member who would like the board of directors to review a decision must submit a written request to that effect within ten (10) days of being informed of the Committee's decision.
4.16 The board of directors may, after examining the file within a period of time it deems reasonable, may uphold or reverse, in whole or in part, the Committee's decision.
4.17 The board of directors must inform the member concerned in writing of the decision it rendered following its review of the original decision.
